AB1263 expands California’s restrictions on “ghost guns” by criminalizing the act of aiding, abetting, or facilitating the unlawful manufacture of firearms, including those made with 3D printers or CNC machines. It broadens civil liability for distributing digital firearm manufacturing files, allowing lawsuits and penalties against those who share or profit from them online. The bill also requires firearm-industry members to verify buyers’ age and provide warnings before selling firearm barrels, accessories, or manufacturing machines, and mandates signature and ID verification for deliveries. Additionally, anyone convicted of certain firearm-related misdemeanors, such as unlawful gun manufacturing, would face a 10-year firearm ownership ban.
The California State Assembly passed AB1263 on September 12, 2025 by a vote of 62 to 13. We have assigned pluses to the nays because this legislation violates the God-given right to self-defense protected by the Second and Ninth Amendments of the U.S. Constitution. Banning individuals from engaging in private, non-commercial firearm production restricts citizens from lawfully exercising this right. Additionally, criminalization of unserialized firearms, also known as ghost guns, imposes unconstitutional government control over personal property. State governments must reject laws that infringe on God-given, constitutionally protected rights.
